Welcome to LaboFans ("LaboFans", "we", "our", or "us").

These Terms and Conditions ("Terms") govern your access to and use of LaboFans.com, including all related services, features, applications, and content available through the platform (collectively, the "Platform").

By accessing or using LaboFans, you agree to be legally bound by these Terms, our Privacy Policy, Creator Agreement, Community Guidelines, and any additional policies published by LaboFans.

If you do not agree with these Terms, you must not access or use the Platform.

1. About LaboFans

LaboFans is an online platform that enables creators ("Creators") to share digital content and interact with users ("Fans") through subscriptions, paid content, messages, livestreams, and other monetization features.

LaboFans provides the technology and infrastructure that connects Creators and Fans.

LaboFans does not create, own, or control Creator content unless explicitly stated otherwise.

2. Definitions

For the purposes of these Terms:

"Platform" means LaboFans.com and all related services.

"User" means any person who accesses or uses the Platform.

"Creator" means a verified user authorized to upload and monetize content.

"Fan" means a user who accesses, subscribes to, or purchases Creator content.

"Content" means all images, videos, audio, text, messages, livestreams, profiles, and other materials uploaded or shared through the Platform.

"Account" means a registered user account.

3. Eligibility

To use LaboFans, you must:

• Be at least 18 years old.

• Have the legal capacity to enter into these Terms.

• Provide accurate and complete information.

• Comply with all applicable laws and regulations.

By creating an account, you confirm that you meet these requirements.

LaboFans reserves the right to refuse registration or terminate accounts that do not meet eligibility requirements.

4. Account Registration

Certain features require you to create an account.

You agree to:

• Provide accurate information.

• Keep your account information updated.

• Maintain the confidentiality of your login credentials.

• Notify us immediately of unauthorized access.

• Accept responsibility for activity occurring under your account.

You may not:

• Create an account using false information.

• Impersonate another person.

• Create multiple accounts to abuse the Platform.

• Sell, transfer, or share your account.

5. Creator Accounts

Creators must complete identity verification before accessing monetization features.

Creators agree that:

• All submitted information is accurate.

• They own or have rights to uploaded content.

• They comply with applicable laws.

• They respect the rights and privacy of others.

• They follow the Creator Agreement and Community Guidelines.

Additional requirements may apply to Creators, including identity verification and documentation requirements.

6. Identity Verification (KYC)

LaboFans may require users, particularly Creators, to complete identity verification ("KYC") before accessing certain features, including monetization, posting content, or receiving a verified badge.

Before starting verification, you must confirm your email address and provide your date of birth. You must be at least 18 years old to complete verification.

Verification may include:

• Submission of a government-issued photo identification document.

• A live selfie or liveness check to confirm you are the person shown on the ID.

• Additional documentation or information required by law, payment providers, or platform policy.

Identity verification may be conducted through our authorized third-party verification partner (currently Didit). When you start verification, you will be redirected to our partner's secure portal. By proceeding, you authorize LaboFans to share the information necessary to complete verification with that provider, and you agree that your use of the verification service is also subject to the provider's applicable terms and privacy policy.

LaboFans and/or our verification partner may approve, reject, or request additional information. We may suspend, restrict, or terminate accounts if verification is not completed, fails, is rejected, or if fraudulent, misleading, or inaccurate information is provided.

Information collected during verification is processed as described in our Privacy Policy. This may include identity documents, verification images, and biometric data collected for liveness detection. We may retain verification records as required for legal, security, fraud-prevention, and compliance purposes.

Failure to complete or maintain verification may result in loss of access to monetization features, removal of a verified badge, suspension of payouts, or account termination.

7. Fan Accounts

Fans may use the Platform to:

• Follow Creators.

• Purchase subscriptions.

• Purchase paid content.

• Send tips.

• Communicate with Creators.

Fans agree that purchased access provides a limited personal-use license only.

Fans may not:

• Copy Creator content.

• Download, distribute, or sell Creator content.

• Share paid content outside the Platform.

• Use Creator content for commercial purposes.

8. Content Rules

Users are responsible for all content they upload, share, or transmit.

Content must not include:

• Illegal activities.

• Content involving persons under 18 years old.

• Non-consensual material.

• Harassment or threats.

• Hate speech.

• Fraudulent activity.

• Copyright infringement.

• Malware or harmful software.

• Content violating applicable laws.

LaboFans may remove any content that violates these Terms or our policies.

9. Creator Content and Intellectual Property

Creators retain ownership of their original content.

By uploading content, Creators grant LaboFans a limited license to:

• Host and display content.

• Deliver content to authorized users.

• Operate platform features.

• Improve technical performance.

• Promote LaboFans using permitted previews.

Fans receive only the rights expressly granted through the Platform.

No ownership rights are transferred.

10. Payments and Purchases

LaboFans may allow purchases including:

• Subscriptions.

• Paid messages.

• Pay-per-view content.

• Tips.

• Other paid features.

Prices are displayed before purchase.

By completing a purchase, you authorize LaboFans and its payment providers to process the transaction.

Payments may be subject to:

• Payment processing fees.

• Currency conversion fees.

• Refund policies.

• Chargebacks.

• Fraud prevention measures.

11. Refunds and Chargebacks

Due to the digital nature of Creator content, refunds may be limited except where required by applicable law.

LaboFans may investigate:

• Fraudulent transactions.

• Unauthorized payments.

• Payment disputes.

If a payment is reversed, LaboFans may recover the amount from the relevant account.

12. Prohibited Activities

Users may not:

• Violate any law.

• Attempt unauthorized access.

• Interfere with Platform security.

• Use automated systems to scrape content.

• Circumvent payment systems.

• Manipulate engagement metrics.

• Harass other users.

• Misrepresent identity.

• Conduct scams or fraudulent activities.

13. Moderation and Enforcement

LaboFans may:

• Review content.

• Restrict visibility.

• Remove content.

• Suspend accounts.

• Terminate accounts.

• Restrict access to features.

We are not required to publish or maintain any specific content.

14. Privacy

Your use of LaboFans is also governed by our Privacy Policy.

We collect and process personal information as described in our Privacy Policy, including information necessary to:

• Operate the Platform.

• Maintain security.

• Verify identities.

• Process payments.

• Comply with legal obligations.

15. Third-Party Services

18. Limitation of Liability

To the maximum extent permitted by applicable law, LaboFans shall not be liable for:

• Lost revenue.

• Business interruption.

• Data loss.

• Consequential damages.

Nothing in these Terms limits liability where such limitation is prohibited by law.

19. Indemnification

You agree to defend, indemnify, and hold harmless LaboFans and its affiliates, employees, partners, and service providers from claims arising from:

• Your use of the Platform.

• Your content.

• Your violation of these Terms.

• Your violation of applicable laws.

• Your infringement of third-party rights.

20. Account Suspension and Termination

LaboFans may suspend or terminate accounts where:

• These Terms are violated.

• Fraud is suspected.

• Security risks exist.

• Illegal activity is suspected.

• Required verification is not completed.

Upon termination:

• Access may end immediately.

• Content may be removed.

• Outstanding obligations may remain enforceable.

Updated Terms will be published on the Platform with a revised update date.

Your continued use of LaboFans after changes become effective means you accept the updated Terms.

22. Governing Law

These Terms are governed by the laws of Switzerland, excluding conflict-of-law principles.

Any disputes shall be resolved by the competent courts according to applicable Swiss law, unless mandatory law provides otherwise.

23. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

24. Entire Agreement

These Terms, together with:

• Privacy Policy;

• Creator Agreement;

• Community Guidelines;

• Other published policies;

constitute the complete agreement between you and LaboFans regarding your use of the Platform.
