Welcome to LaboFans ("LaboFans", "we", "our", or "us").

This Creator Agreement ("Agreement") governs your use of LaboFans as a content creator. By applying for, accessing, or using a Creator Account, you agree to be legally bound by this Agreement, our Terms of Service, Privacy Policy, Community Guidelines, and any other policies published by LaboFans.

If you do not agree to this Agreement, you must not create or use a Creator Account.

1. Definitions

For purposes of this Agreement:

  • Platform means LaboFans.com.

  • Creator means any verified user authorized to upload monetized content.

  • Fan means a user who purchases subscriptions or other paid content.

  • Content means all photos, videos, livestreams, audio, text, messages, digital files, or other materials uploaded by a Creator.

  • Creator Earnings means amounts payable to a Creator after deducting platform fees, taxes, refunds, chargebacks, and other applicable deductions.

  • Account means your registered Creator account.

2. Eligibility

To become a Creator you represent and warrant that:

  • You are at least 18 years old.

  • You have reached the age of majority in your jurisdiction.

  • You possess legal capacity to enter into this Agreement.

  • All information you provide is accurate and truthful.

  • You will promptly update your information if it changes.

  • You are not prohibited by law from using our services.

Providing false information may result in immediate account termination.

3. Identity Verification

Before earning money or receiving a verified badge, every Creator must successfully complete identity verification (KYC).

Before starting verification, you must confirm your email address and provide your date of birth. You must be at least 18 years old.

Verification may include:

  • Government-issued photo identification.

  • A live selfie or liveness check to confirm you are the person shown on the ID.

  • Proof of address.

  • Tax documentation where required.

  • Additional verification requested by LaboFans.

Identity verification is conducted through our authorized third-party verification partner (currently Didit). When you start verification, you will be redirected to our partner's secure portal. By proceeding, you authorize LaboFans to share the information necessary to complete verification with that provider.

We may reject verification requests at our sole discretion. Failure to complete or maintain verification may result in suspension of payouts, loss of verified status, or account removal.

4. Creator Account Responsibilities

You are solely responsible for:

  • Maintaining account security.

  • Protecting your password.

  • All activity occurring under your account.

  • Maintaining accurate payment information.

  • Complying with all applicable laws.

You must immediately notify us if you suspect unauthorized access.

5. Content Ownership

You retain ownership of your original content.

However, by uploading content to LaboFans, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Host your content.

  • Store your content.

  • Display your content.

  • Distribute your content to paying users.

  • Encode, compress, resize, optimize, and adapt your content for platform functionality.

  • Promote the Platform using previews, thumbnails, screenshots, or promotional excerpts unless you opt out where permitted.

This license ends when your content is permanently removed from our systems, except where retention is legally required.

6. Your Representations

You represent that:

  • You own all uploaded content.

  • You possess all necessary licenses and permissions.

  • Your content does not infringe copyrights.

  • Your content does not violate trademarks.

  • Your content does not violate privacy rights.

  • Every identifiable individual appearing in your content has provided valid legal consent.

  • Every person appearing in your content is at least 18 years old.

You agree to provide documentation proving these representations upon request.

7. Record Keeping

Creators must maintain legally sufficient documentation proving:

  • Identity of every participant.

  • Age verification.

  • Written consent.

  • Ownership rights.

LaboFans may request copies of these records at any time.

Failure to provide requested documentation may result in immediate removal of content or account termination.

8. Prohibited Content

Creators may not upload content that includes or promotes:

  • Anyone under 18 years of age.

  • Non-consensual acts.

  • Violence or threats.

  • Human trafficking.

  • Sexual exploitation.

  • Incest.

  • Bestiality.

  • Illegal drugs.

  • Criminal activity.

  • Terrorism.

  • Hate speech.

  • Harassment.

  • Revenge pornography.

  • Stolen content.

  • Deepfakes intended to deceive.

  • Fraud.

  • Malware.

  • Copyright infringement.

  • Content violating applicable laws.

LaboFans reserves sole discretion in determining prohibited content.

9. Content Moderation

LaboFans may:

  • Review uploaded content.

  • Remove content.

  • Restrict visibility.

  • Suspend accounts.

  • Terminate accounts.

  • Require additional verification.

We are under no obligation to publish or continue displaying any content.

10. Community Standards

Creators agree to interact respectfully with users.

The following are prohibited:

  • Harassment

  • Threats

  • Doxxing

  • Spam

  • Scams

  • Misleading advertising

  • Impersonation

  • False claims

  • Manipulation of rankings

  • Artificial engagement

11. Earnings

Creators may earn revenue from features including:

  • Subscriptions

  • Tips

  • Pay-Per-View content

  • Messages

  • Livestreams

  • Other monetization features offered by LaboFans

The current revenue share is displayed in your Creator Dashboard and may be updated from time to time.

12. Platform Fees

LaboFans retains a platform fee from creator revenue.

Fees may vary depending upon:

  • Payment processor costs

  • Taxes

  • Country

  • Currency

  • Promotional programs

Current fees are published separately.

13. Payouts

Creator earnings become payable only after:

  • Successful payment processing.

  • Fraud review.

  • Expiration of applicable holding periods.

  • Deduction of refunds, taxes, chargebacks, and fees.

Minimum payout thresholds may apply.

LaboFans is not responsible for delays caused by payment providers.

14. Taxes

Creators are solely responsible for:

  • Income taxes.

  • VAT.

  • GST.

  • Sales taxes.

  • Business registrations.

  • Tax reporting.

LaboFans may collect tax documentation where legally required.

15. Chargebacks and Refunds

If a payment is reversed due to:

  • Chargeback

  • Fraud

  • Refund

  • Payment reversal

LaboFans may deduct the corresponding amount from future Creator earnings.

Negative balances remain payable by the Creator.

16. Intellectual Property

You may not upload any content that infringes another person's intellectual property rights.

Repeated infringement may result in permanent account termination.

17. DMCA and Copyright Complaints

LaboFans respects intellectual property rights.

If we receive a valid copyright complaint, we may:

  • Remove content.

  • Disable access.

  • Suspend accounts.

  • Terminate repeat infringers.

18. Privacy

Creators agree to comply with all applicable privacy laws.

You may not publish another person's:

  • Personal information

  • Government identification

  • Home address

  • Financial information

  • Private communications

without lawful authorization.

19. Artificial Intelligence

If AI-generated or AI-enhanced content is permitted under our policies, Creators must accurately disclose such content where required.

Creators remain responsible for ensuring AI-assisted content complies with this Agreement and applicable law.

20. Exclusivity

Unless separately agreed in writing, this Agreement does not require exclusivity.

Creators remain free to publish content on other platforms.

21. Promotions

Creators are responsible for ensuring advertisements and promotional activities comply with applicable advertising laws and platform policies.

Spam and deceptive marketing are prohibited.

22. Suspension

LaboFans may suspend accounts immediately if:

  • This Agreement is violated.

  • Fraud is suspected.

  • Verification fails.

  • Required documents are not provided.

  • We believe continued operation presents legal or security risks.

23. Termination

Either party may terminate this Agreement.

Following termination:

  • Access may end immediately.

  • Content may be removed.

  • Outstanding investigations may continue.

  • Required legal records may be retained.

  • Outstanding balances may be withheld pending review.

24. Limitation of Liability

To the fullest extent permitted by law, LaboFans shall not be liable for:

  • Lost profits

  • Lost revenue

  • Lost business opportunities

  • Indirect damages

  • Incidental damages

  • Consequential damages

  • Data loss

  • Service interruptions

Our total liability shall not exceed the amount paid to you by LaboFans during the twelve (12) months preceding the event giving rise to the claim.

25. Indemnification

You agree to defend, indemnify, and hold harmless LaboFans, its owners, affiliates, officers, employees, contractors, and partners from any claims, liabilities, damages, losses, costs, or legal expenses arising from:

  • Your content;

  • Your use of the Platform;

  • Your breach of this Agreement;

  • Your violation of any law; or

  • Your infringement of any third-party rights.

26. Changes to this Agreement

We may modify this Agreement at any time.

Material changes will become effective upon publication unless a different effective date is stated.

Continued use of your Creator Account after changes constitutes acceptance of the updated Agreement.

27. Governing Law

This Agreement shall be governed by the laws specified in the LaboFans Terms of Service or the jurisdiction designated by LaboFans.

Any disputes shall be resolved in the courts having jurisdiction under those governing terms unless applicable law requires otherwise.

28. Severability

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

29. Entire Agreement

This Agreement, together with the Terms of Service, Privacy Policy, Community Guidelines, and any additional policies published by LaboFans, constitutes the entire agreement between you and LaboFans regarding your use of the Creator services.
